Ethics Policy

Introduction

Unity Bancorp, Inc., Unity Bank (collectively, "Unity") regards the working relationship with customers, clients and other organizations as paramount and equally regards the integrity demonstrated by all directors, officers and employees as indispensable to that effective relationship.

Unity Bank Core Values Test in situations where you are uncertain what to do, ask yourself these questions:

  1. Is the action legal?
  2. Does it comply with our Code of Business Conduct and Ethics and related policies?
  3. Does it reflect our Core Values (Unity Bank Commandments)?
  4. Would I be comfortable if my friends and family knew about it?
  5. Would it be OK if other employees did it?
  6. Would it keep Unity Bank and our shareholders from experiencing loss, harm, or unnecessary risk?
  7. Does it feel like the right thing to do?
  8. If you answered “no” to any of these questions, don’t do it.

The general rule of thumb to follow is: If you know it’s wrong, don’t do it. If you’re not sure, ask yourself the questions above. If you still are unsure on what to do, speak with your supervisor or the Human Resources Director. Keep asking until you have clarity on following the right path.

Anyone who works for, with or on behalf of Unity Bank has the responsibility to demonstrate the highest standards of business conduct. This Code of Business Conduct & Ethics applies to all officers, directors, employees and contractors of Unity Bank, our subsidiaries and our affiliates. Anyone who violates the spirit or letter of the Code may face disciplinary action, up to and including termination.

Therefore, it is the policy of Unity that all directors, officers and employees observe and comply with the following:

Corporate Statement 

A financial institution’s activities are affected by laws and regulations, as well as its responsibilities to its shareholders, clients, employees, and the community in which it serves.  The Unity Bank Ethics Policy provides the avenue for ensuring that the conduct of its employees is consistent with the institution’s corporate responsibilities.

The Unity Bank Ethics Policy embodies not only legal and regulatory requirements, but also the standards by which our employees must conduct themselves.

Conflict of Interest

A financial institution’s reputation for integrity is its most valuable asset and is directly affected by the conduct of its Employees, Officers and Directors (collectively hereinafter referred to as “Employees”).  For this reason, Employees must not use their position for private gain, to advance personal interests, or to obtain favors or benefits for themselves, members of their families, or any other individuals, corporations, or business entities.

A basic premise of the Unity Bank Ethics Policy is that each Employee represents Unity Bank and is obligated to act in Unity Bank’s best interest, and in the best interests of its clients and stockholders, without regard to the employee’s personal or financial interest or activities.  Employees are expected to recognize and avoid those situations where personal or financial interest or relationships might influence or appear to influence the Employee’s judgment on matters affecting our institution.

Employees should understand that a conflict of interest, or the appearance of a conflict of interest, may arise when there is a mere opportunity for conflict to occur.  Although Employees may not intend to create a conflict of interest, they should manage their affairs to avoid even the appearance of such a conflict.  If an employee has any doubt about a certain situation, the employee should contact his/her manager to discuss immediately.

Confidential Information

The unauthorized use or release of confidential information during or after employment with Unity Bank is a breach of the Unity Bank Ethics Policy. Confidential information with respect to Unity Bank, its clients, prospective clients, suppliers, shareholders, and employees acquired in the course of business is to be used solely for corporate purposes and never to be discussed with or divulged to unauthorized people. The need for confidentiality extends to everyone, including family, friends, and acquaintances.

Clients, suppliers, shareholders, and employees expect Unity Bank and its employees to always keep information regarding their personal and business affairs in strict confidence. Examples of confidential information include the following: clients', suppliers', shareholders' or employees' business relationships, loans, accounts, balances, credit ratings, experiences, or any other transaction with Unity Bank. Other examples of confidential information include, but are not limited to corporate policies, objectives, goals, and strategies; lists of clients, clients or vendors; employee records; and other materials such as graphs, memoranda, documents, manuals, reports, records, software or hardware for use in computer or word processing equipment, training materials, bulletins, and similar originals or copies of records whether or not you have contributed to their creation. When an Employee leaves Unity Bank, the Employee may not retain any confidential information in physical form. 

Confidential information available to one affiliate or department of Unity Bank should only be communicated to other affiliates or departments when there is a legitimate business need to know.
Misuse of confidential information will not only constitute a violation of this Code of Ethics, it may also constitute a violation of state and Federal law.  

Financial Accountability & Internal Controls 

Unity Bank has numerous internal control policies and procedures.  Unity Bank expects all employees to be familiar with and operate within established internal controls.  Unity Bank's internal and external auditors periodically audit internal control policies, procedures, and compliance to assess the sufficiency of these controls.  All employees involved in these periodic assessments shall provide accurate information and shall complete the internal control certifications in a timely manner.

Integrity of Accounting & Financial Information 

Unity Bank maintains the highest standards in preparing the accounting and financial information disclosed to the public. There should never be issued any information that is false, misleading, incomplete or would lead to mistrust by the public, our clients, or our stockholders. All accounting records shall be compiled accurately, with the appropriate accounting entries properly classified when entered on the books.

No payments on behalf of Unity Bank shall be approved or any transaction made with the intention or understanding that part or all of such payment will be used for any purpose other than that described by the documents supporting it. No fund, asset, or liability of Unity Bank shall, under any circumstances or for any purpose, be concealed or used for an unlawful or improper purpose.

Money Laundering & Transaction Structuring 

Unity Bank may unknowingly be used to launder money derived from criminal activity. The intention behind these types of transactions is to hide ownership of the funds from the government.  Unity Bank makes every effort to resist being associated with money laundering or any other type of criminal activity.

Any employee who knowingly and willfully launders money or attempts to or assists someone in laundering money is subject to substantial fines or imprisonment or both. Also, in accordance with the Bank Secrecy Act (“BSA”), any employee who willfully structures a transaction, or attempts or assists someone in structuring a transaction to avoid the currency reporting requirements of BSA is subject to substantial fines and up to twenty years imprisonment. 

Unity Bank employees are prohibited from engaging in money laundering and/or transaction structuring.  All employees are required to immediately report all attempts to launder money, structure a transaction and/or all suspicious activities.

Embezzlement, Theft, And Misapplication of Funds

Unity Bank holds each employee responsible for maintaining accurate and complete records.  Anyone who embezzles, steals, or willfully misappropriates any monies, funds, or credits of Unity Bank is subject to fine or imprisonment or both.

Things Offered to Employees

It is a federal crime for any Officer, Director, Employee, agent or attorney of Unity Bank to corruptly solicit, demand or accept for the benefit of any person anything of value from anyone in return for any business, service or confidential information of Unity Bank, intending to be influenced or rewarded, either before or after a transaction is discussed or consummated. Although all transactions and businesses are covered, some examples include extensions of credit, underwriting transactions, investment advice, trust matters, checking accounts and purchases from suppliers. Any person who improperly offers or promises something of value under these circumstances is guilty of the same offense.  Substantial criminal penalties can result from non-compliance.

It is not uncommon for bankers to have close social or family ties with some of those with whom they do business. Things of value exchanged between a Unity Bank Employee and family members, or social friends are not covered by this Unity Bank Ethics Policy if they are exchanged solely because of the family or social relationship and not in connection with a bank transaction or bank business. However, the exchange of things of value that may create the appearance of a conflict of interest should be avoided.

Although acceptance of things of value in connection with bank business is generally prohibited, the Bank has adopted a reasonableness standard relating to accepting items of value.  Simply defined, Employees, Officers, and Directors may only accept a gift or other thing of value if a reasonably prudent person who exercised an average degree of care, skill, and judgment, under the same circumstances, with similar knowledge of the facts, would have made the same decision.  Alternatively, ask the question whether accepting the thing of value is “reasonable” given the facts and circumstances.

For example, an Employee may accept meals, refreshments, travel arrangements or accommodation, or entertainment, all of reasonable value, in the course of a meeting or other occasion the purpose of which is to hold bona fide business discussions or to foster better business relations, provided the benefit would be paid for by Unity Bank as a reasonable expense if not paid for by another party; examples include, but are not limited to advertising or promotional material of nominal value, such as pens, pencils, note pads, key chains, calendars and similar items; discounts or rebates on merchandise or services that do not exceed those available to other clients; gifts of modest value that are related to commonly recognized events or occasions, such as a promotion, new job, wedding, retirement, Christmas, bas or bar mitzvah; civic, charitable, educational or religious organizational awards for recognition of service and accomplishment.

However, an Employee may not receive things of value for purely personal benefit, or for the personal benefit of anyone else, which serve no demonstrable business purpose.  Gifts of cash or cash equivalent, such as gift cards, in any amount are expressly prohibited.  Furthermore, an Employee may not accept a discount from a Bank customer or vendor that is not available to the public.  On a case-by-case basis, Unity Bank may approve other circumstances, not described herein, in which Employees may accept something of value in connection with Unity Bank business. Approval may be given by Executive Management, after consultation with legal counsel, in writing based on a full written disclosure of all relevant facts submitted by the employee, providing compliance with federal law. 

Whenever any situation arises about matters concerning things of value, Employees must make full disclosure to Unity Bank management and receive management's written response. Permanent files must be maintained of all disclosures and responses.

Things Offered by Employees

Employees may not, on behalf of Unity Bank in connection with any transaction or business of Unity Bank, directly or indirectly give, offer, or promise anything of value to any individual, business entity, organization, governmental unit, public official, political party, or any other person to influence the actions of the recipient. This standard of conduct is not intended to prohibit normal business practices such as providing meals, entertainment, tickets to cultural and sporting events, promotional gifts, favors, discounts, price concessions, gifts given as token of friendship or special occasions (such as Christmas), so long as they are of nominal and reasonable value under the circumstances and promote Unity Bank's legitimate business interests, and are not designed to provide a quid pro quo for granting business to Unity Bank.

Outside Activities

Employees' activities must not interfere or conflict with the interests of Unity Bank. Acceptance of outside employment, outside speaking engagements, election to the Board of Directors of other organizations, representation of Unity Bank clients in dealings with Unity Bank, and participation in activities on behalf of outside organizations or in political activities represent potential conflicts of interest.

Appropriate gainful employment outside the Unity Bank system is permissible but discouraged. Employees should not engage in outside employment that interferes with the time and attention that must be devoted to their duties at Unity Bank or adversely affects the quality of the work they perform.

Outside employment should not compete or conflict with the activities of Unity Bank; involve any use of company equipment, supplies, or facilities; imply Unity Bank's sponsorship or support; or adversely affect Unity Bank’s reputation. Employees must disclose any existing outside employment to Executive Management who may disapprove due to time considerations and/or conflict(s) of interest.

Unity Bank encourages Employees to participate in worthwhile civic, social, educational, and charitable organizations and activities. However, employees must not act without Executive Management approval in the following capacities: any signing capacity on any account of another, except a family member, held in Unity Bank; an official of any organization, except for social, religious, philanthropic or civic organization, colleges or schools, neighborhood associations, clubs within Unity Bank or trade or professional organizations associated with banking or business.

The Bank recognizes that social media is an increasingly common communication tool.  Employees must consider how their personal use of social media reflects upon the Bank.  Public comments disparaging the Bank, revealing trade secrets or confidential information is strictly prohibited.  Employees must not conduct Unity Bank business transactions through any social media platform.  Employees may express their personal opinions, but never represent themselves as a spokesperson for the Bank in any way.  Employees must also refrain from using social media while on work time or equipment unless it is work-related as authorized by a Manager.

Sound Personal Finances

  • The way Employees manage their personal finances can affect on-the-job performance and Unity Bank's image in the community. Therefore, Employees must avoid any circumstances that may lead to over extension of credit or salary attachments or drawing checks against insufficient funds or other financially embarrassing situations.  Deposit Services monitors all Employee overdrafts and notifies an Employee’s manager when they occur.  Employees are then counseled on the importance of avoiding future overdrafts.
  • Continued misuse of a Unity Bank deposit account by an Employee may lead to disciplinary action, including termination of employment.
  • Employees and their families should borrow only from financial institutions that regularly lend money. Borrowing may be done only on a normal basis with no favored treatment. 
  • Employees and their families may not borrow from clients and suppliers except those who engage in lending in the usual course of their business and then only on terms customarily offered to others under similar circumstances without special concessions as to interest rate, terms, security, repayment terms and penalties.

Requirements to Report Violations

If an Employee believes he/she will be in violation of this Unity Bank Ethics Policy and/or other  activity that violates law, regulation or Unity Bank policy, or business abuses, or if an Employee has suspicions of others involved in the same, the situation must be reported immediately to one's manager, Human Resources Director, Compliance Officer, Chairman of the Audit Committee of the Board, or another officer of Unity Bank, or by use of the Bank’s reporting hotline discussed below.  Failure to report is a violation of this Policy and can lead to disciplinary action against the person who failed to report the violation, which may be as severe as the disciplinary action against the person who committed the original violation.

Whenever possible, you are encouraged to raise questions and concerns directly with your manager, or someone in your department’s reporting line with whom you feel comfortable talking. In many cases, your manager can resolve issues, or help guide you through the appropriate process. If you are not comfortable doing so, the following resources are also available to you:

The identity of the person who reports a possible violation of this Code by another will be kept confidential to the extent possible. However, circumstances may exist that require Unity Bank to disclose the name of a  person who reports a possible violation.  Possible violations may be reported orally or in writing and may be reported anonymously.
Unity Bank has a zero-tolerance policy for intimidation or retaliation against individuals who make good-faith reports of known or suspected violations of this Code, any Unity Bank policy or procedure, or any law or regulation.

Acknowledgement

Every employee will be required to sign a statement that he or she has read this Unity Bank Ethics Policy and understands it provisions and agrees to abide by them. Employees will be required to provide an annual acknowledgment.

Unity Bank Ethics Policy Violations

Any employee who violates any section of this Unity Bank Ethics Policy is subject to disciplinary action up to and including termination.

Investigations

The Bank investigates every concern that employees report through any channel. Every report of a violation is taken seriously. You are required to cooperate fully with any authorized internal or external investigation, including, but not limited to, those involving ethical issues, legal or regulatory issues, or policy violations. You should never withhold, tamper with, or fail to communicate relevant information in connection with any investigation. Making false statements may be grounds for immediate termination. If the investigation determines a violation has occurred, prompt corrective action will be taken, up to and including termination.

Matters Not Covered by This Statement

The Bank recognizes that it is impossible to define every practice that could constitute an objectionable conflict.  The omission of any specific policy of limitation or prohibition noted above, however, shall not be regarded as approval of practices or conditions not specifically covered, and the Board of Directors will take appropriate action to prevent and eliminate conflicts when circumstances so warrant.

GENERAL PROVISIONS

Failure by Unity Bank to enforce any provision(s) of this Agreement shall not be as a waiver thereof. This Agreement and all other aspects of your use of the Site shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of laws rules. All claims and disputes arising out of this Agreement or your use of the Site, other than actions for specific performance or injunctive relief brought by Unity Bank, shall be exclusively brought in the federal, state, or local courts located in New Jersey, and, with regard to such claims and disputes, you hereby irrevocably (i) submit to the exercise of personal jurisdiction over you by those courts and (ii) waive any jurisdictional, venue, or inconvenient forum objections to such courts. Any cause of action you may have with respect to the Content, Site or this Agreement must be commenced within one (1) year after the claim or cause of action arose, or be barred. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall be enforced to the fullest extent possible, and the remaining provisions of the Agreement shall remain in full force and effect. You many not assign this Agreement, by operation of law or otherwise, without Unity Bank's prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and be enforceable against the parties and their respective successors and assigns. Neither the course of conduct between parties nor trade practice shall act to modify any provision of the Agreement. All rights not expressly granted herein are hereby reserved.

Your Ability to Withdraw Funds

Our policy is to make certain funds from your check deposits available to you on the first business day after the day we receive your deposit. Electronic direct deposits and wire transfers will be made available on the day we receive the deposited funds. For determining the availability of your deposits, every day is a business day, except Saturdays, Sundays, and federal holidays. If you make a deposit on a business day at any one of our branches prior to closing time, we will consider that day to be the business day of your deposit. However, if you make a mobile deposit after 4:00 p.m.; a deposit at a proprietary ATM after 3:00 p.m.; or a remote deposit capture deposit after 6:00 p.m. on a day the Bank is open, we will consider the deposit to be made on the next business day.

Longer Delays May Apply

In some cases, we will not make all of the funds that you deposit by check available to you on the first business day after the day of your deposit. Depending on the type of check that you deposit, funds may not be available until the second business day after the day of your deposit. The first $225 of your deposits, however, may be available on the first business day.

If we are not going to make all of the funds from your deposit available on the first business day, we will notify you at the time you make your deposit. We will also tell you when the funds will be available. If your deposit is not made directly to one of our employees, or if we decide to take this action after you have left the premises, we will mail you the notice by the day after we receive your deposit. If you will need the funds from a deposit right away, you should ask us when the funds will be available. In addition, funds you deposit by check may be delayed for a longer period under the following circumstances:

  • We believe a check you deposit will not be paid
  • You deposit checks totaling more than $5,525 on any one day.
  • You redeposit a check that has been returned unpaid.
  • You have overdrawn your account repeatedly in the last six months.
  • There is an emergency, such as failure of computer or communications equipment.

We will notify you if we delay your ability to withdraw funds for any of these reasons, and we will tell you when the funds will be available. They will generally be available no later than the seventh business day after the day of your deposit.

Privacy Policy for the Card Control (CardValet) Service

  1. Introduction. This Privacy Policy describes the types of "Personal Information" (information that is identifiable to a particular person) that is collected (directly or through service providers) in connection with the Card Control (CardValet) downloadable application ("App") and related services (collectively, the "Service") offered by your financial institution ("we" or "us"). This Privacy Policy is intended to supplement the disclosures in any Privacy Policy that you may have already been presented by us in connection with online banking or other services.

  2. Eligibility. The Service is offered only to individual residents of the United States, excluding its territories, who can form legally binding contracts under applicable law. Without limiting the foregoing, the Service is not offered to minors. Other restrictions and eligibility requirements for the Service apply as described in the Card Control (CardValet) Terms of Use. We do not knowingly collect any Personal Information from or about individuals under 18 years of age. Please do not submit such information to us, and as a parent or legal guardian, please do not allow your children to submit Personal Information without your permission. By using the App or the Service, you represent that you meet these requirements and that you agree to the terms of this Privacy Policy.

  3. What Types of Personal Information We May Collect. We may collect Personal Information about you, which may include: name, postal address, zip code, e-mail address, telephone number, account numbers, payment card expiration date, payment card identification or verification numbers, social security number, mobile device location, and other information that we can use to contact you, verify your identity, provide the functionality available through use of the App and the Service, and manage risks, such as information maintained about you by identity verification services and consumer reporting agencies, including credit bureaus, and payment and other transaction information, and history for payments and other transactions in which you participate through the Service, and any Personal Information that you may enter into information blocks present in the App interface or made available through the Service. We may collect information regarding your mobile device such as device settings, unique device identifiers, information about your location, and analytical information that may assist with diagnostics and performance. For your convenience, you may be asked to grant permission for access to your mobile device's geolocation data. This information may be collected when you use certain services that are dependent on your mobile device’s location (such as the location of an ATM or in store transactions).

  4. How We May Collect Personal Information About You. We may collect Personal Information about you from the following sources:
    1. Information that you input to the App or that the App collects automatically;
    2. Your use of the App and the Service, and your interactions with customer care, including information you enter or speak, and information transmitted by your computer or mobile device or other devices you use as part of your receipt of the Service; and
    3. We may also collect Personal Information about you from others, such as Affiliates, or other companies (such as for fraud detection).

  5. How We May Share Personal Information About You. We share Personal Information about you only as permitted by law. For Personal Information that is nonpublic and that we collect in connection with a financial service, U.     3. For marketing purposes - to offer products and services to you, although you may opt-out of receiving commercial email marketing messages from us by following the opt-out processes described in those messages; and
    4. If we are involved in a merger, acquisition, or sale of all or a portion of our assets that results in a change of the majority ownership of the App or the Service or the entity that owns them, you will be notified of this via email and/or a prominent notice on the App, as well as any material change in uses of your Personal Information, as well as any choices you may have regarding Personal Information about you.

  2. Other Important Information.

    Vermont: Under Vermont law, we will not share information we collect about Vermont residents with companies outside of our Affiliates, unless the law allows. We will not share information about your credit worthiness with our Affiliates except with your consent, but we may share information about our transactions or experiences with you with our Affiliates without your consent.

    California: Under California law, we will not share information we collect about you with Nonaffiliates, unless the law allows. For example, we may share information with your consent, to service your accounts, or to provide rewards or benefits you are entitled to. We will limit sharing among our Affiliates to the extent required by California law.


  3. Definitions.
    1. "Affiliates" means companies related by common ownership or control. They can be financial or nonfinancial companies.
    2. "Nonaffiliates" means companies not related by common ownership or control. They can be financial or nonfinancial companies.
    3. "Joint Marketing" means a formal agreement between nonaffiliated financial companies that together market financial products or services to you.

  4. How We Protect Personal Information About You. To protect Personal Information about you from unauthorized access and use, we maintain physical, electronic, and procedural safeguards, including but not limited to security measures that comply with applicable federal and state laws. We also require our service providers and business partners to whom we disclose the information to do the same. When you enter sensitive information (such as a debit or credit card number) into the App, we encrypt the transmission of that information using secure socket layer technology (SSL). We may retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

  5. Data Retention. We will retain, protect, use and share Personal Information about you as long as it is reasonably required for the purposes described in this Privacy Policy, and as required by law, including but not limited to for risk management, regulatory compliance, and audit purposes.

  6. Amendments. We may amend this policy at any time by posting a revised version in the App. The revised version will be effective immediately at the time it is posted unless a delayed effective date is expressly stated therein. You may (in our discretion) also be provided with an email notification of such amendments. If we make any change in how we use your Personal Information, we will notify you by email or by means of a notice in the App prior to the change becoming effective. You may (in our discretion) be required to affirmatively acknowledge or accept the revised Privacy Policy in order to continue using the App and the Service. Any use of the App or the Service after a notice of change will constitute your express agreement to such changes.

  • Get real-time balances for your accounts.
  • Manage your money.
  • View your transactions and statements.
  • Make transfers.
  • Pay your bills and manage billers.
  • Deposit a check.
  • Receive alerts.
  • Manage cards.

This Privacy Policy, in combination with other relevant privacy notices that we provide—Example: pursuant to financial privacy laws—is to inform you of the policies and practices regarding the collection, use and disclosure of any personal information that we and our service providers collect from or about users in connection with the App’s website, and mobile application (the “Services”).

THE TYPES OF INFORMATION WE COLLECT IN THE APP
Through your use of the Services, we may collect personal information from you in the following ways:

  1. Personal Information You Provide to Us
    We may collect personal information from you, such as your first and last name, address, email, telephone number, and social security number when you create an account. We will collect the financial and transaction information necessary to provide you with the Services, including account numbers, payment card expiration date, payment card identification, verification numbers, and transaction and payment history. If you provide feedback or contact us via email, we will collect your name and email address, as well as any other content included in the email, in order to send you a reply.

    We also collect other types of personal information that you provide voluntarily, such as any information requested by us if you contact us via email regarding support for the Services.

  2. Personal Information Collected from Third Parties—We may collect certain information from identity verification services and consumer reporting agencies, including credit bureaus, in order to provide some of our Services.

  3. Personal Information Collected Via Technology—We and our service providers may automatically log information about you, your computer or mobile device, and your interaction over time with our Services, our communications, and other online services, such as: Device data, such as your computer or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (example: phone, tablet), IP address, unique identifiers, language settings, mobile device carrier, radio/network information (example: Wi-Fi, LTE, 3G), and general location information such as city, state, or geographic area.

    Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to the Service, navigation paths between pages or screens, information about your activity on a page or screen, access times, and duration of access. Cookies, which are text files that websites store on a visitor’s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, enabling functionality, and helping us understand user activity and patterns. Local storage technologies, like HTML5 and Flash, that provide cookie-equivalent functionality but can store larger amounts of data, including on your device outside of your browser in connection with specific applications.

    Web beacons, also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked. Location Information. If you have enabled location services on your phone and agree to the collection of your location when prompted by the Services, we will collect your location information when you use the Services; for example, to provide our fraud detection services. If you do not want us to collect this information, you may decline the collection of your location when prompted or adjust the location services settings on your device.

  4. Location Information—If you have enabled location services on your phone and agree to the collection of your location when prompted by the Services, we will collect location data when you use the Services even when the app is closed or not in use; for example, to provide our fraud detection services. HOW WE USE YOUR INFORMATION COLLECTED IN THE APP

  1. General Use—In general, we use your personal information collected through your use of the Services to respond to your requests as submitted through the Services, to provide you the Services you request, and to help serve you better. We use your personal information, in connection with the App, in the following ways: Facilitate the creation of, and secure and maintain your account; Identify you as a legitimate user in our system; Provide improved administration of the Services; Provide the Services you request; Improve the quality of experience when you interact with the Services; Send you administrative email notifications, such as security or support and maintenance advisories; and Send surveys, offers, and other promotional materials related to the Services.

  2. Compliance and protection—We may use your personal information to: Comply with applicable laws, lawful requests and legal process, such as to respond to subpoenas or requests from government authorities; Protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims); Audit our internal processes for compliance with legal and contractual requirements and internal policies; Enforce the terms and conditions that govern the Service; and Prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical, or illegal activity, including cyberattacks and identity theft.

The App may contain links to third party websites. When you click on a link to any other website or location, you will leave the App and go to another site, and another entity may collect personal and/or anonymous information from you. The App’s provision of a link to any other website or location is for your convenience and does not signify our endorsement of such other website or location or its contents. We have no control over, do not review, and cannot be responsible for, these outside websites or their content. Please be aware that the terms of this Privacy Policy do not apply to these outside websites. We encourage you to read the privacy policy of every website you visit.

YOUR CHOICES REGARDING YOUR INFORMATION

You have several choices regarding use of information on the Services.

  1. How We Respond to Do Not Track Signals—Some web browsers transmit “do not track” signals to the websites and other online services with which your web browser communicates. There is currently no standard that governs what, if anything, websites should do when they receive these signals. We currently do not take action in response to these signals. If and when a standard is established, we may revise its policy on responding to these signals.

  2. Access, Update, or Correct Your Information—You can access, update, or correct your information by changing preferences in your account. For additional requests, please contact us.

  3. Opting Out of Email or SMS Communications—If you have signed-up to receive our email marketing communications, you can unsubscribe any time by clicking the "unsubscribe" link included at the bottom of the email or other electronic communication. Alternatively, you can opt out of receiving marketing communications by contacting us at the contact information under "Contact Us" below. If you provide your phone number through the Services, we may send you notifications by SMS, such as provide a fraud alert. You may opt out of SMS communications by unlinking your mobile phone number through the Services.

  4. Opting Out of Location Tracking—If you initially consented to the collection of geo-location information through the Services, you can subsequently stop the collection of this information at any time by changing the preferences on your mobile device. Please note, if you withdraw consent to our collection of location information, you may no longer be able to use some features of the App.

SAFEGUARDS AND RETENTION

We implement reasonable administrative, technical, and physical measures in an effort to safeguard the information in our custody and control against theft, loss and unauthorized access, use, modification, and disclosure. Nevertheless, transmission via the internet is not completely secure and we cannot guarantee the security of your information.

A NOTE ABOUT CHILDREN

The Services are not directed towards individuals under the age of 18, and we do not, through the App, intentionally gather personal information about visitors who are under the age of 18. If a child under 18 submits personal information to us through the App and we learn that the personal information is the information of a child under 18, we will attempt to delete the information as soon as possible.

PRIVACY POLICY UPDATES

This Privacy Policy is subject to occasional revision. We will notify you of any material changes in its collection, use, or disclosure of your personal information by posting a notice on the Services. Any material changes to this Privacy Policy will be effective thirty (30) calendar days following notice of the changes on the Services.
